Terms of Service

The agreement between you and Zukaongo when you browse, order or pay on ZUKA.

Effective October 21, 2026Updated October 21, 2026Version 1.0

At a glance

  • ZUKA is a marketplace: independent restaurants and grocery stores sell and prepare your order.
  • You see the full price, fees and total before you pay.
  • Unpaid orders can be cancelled in the app; paid orders go through a refund request.
  • Nothing here removes consumer rights you have under the law.

1Acceptance#

By using the ZUKA website or apps, or by placing an order, you agree to these Terms of Service and to the policies they refer to, such as the Refund & Cancellation Policy and the Privacy Policy.

If you do not agree with these Terms, please do not use ZUKA.

2Who provides the service#

ZUKA (zukaongo.com) is operated by Zukaongo. For orders in the Cayman Islands your contract is with Zukaongo (Cayman Islands). For any activity in the United States, where it applies, your contract is with Zukaongo (United States), a separate company.

ZUKA is a marketplace. It connects you with independent restaurants and grocery stores (“vendors”) and, when you choose delivery, with independent drivers. Vendors prepare and sell the food and groceries; ZUKA is not the seller unless checkout says so.

3Eligibility and your account#

You must be 18 or older to create an account and place orders.

Give accurate contact and delivery details and keep your sign-in details private. You are responsible for activity on your account. Tell us straight away at info@zukaongo.com if you think someone else has used it.

You can browse as a guest where that is enabled. Placing an order needs an account so we can confirm payment, send receipts and manage delivery or pickup.

4Orders#

When you place an order you make an offer to buy the items in your cart. The order is accepted when payment succeeds and the order is confirmed in the app.

We or the vendor may decline or cancel an order for a legitimate reason, for example when an item is unavailable, payment fails, the address is outside the delivery area, or we suspect fraud or a safety issue. If you have already paid for something that is cancelled, we refund it under the Refund & Cancellation Policy.

5Prices, fees and promotions#

Menu prices are set by vendors. Delivery fees, small-order fees, service fees, tax and any tip you add are shown before you confirm, together with the final total you will pay.

Prices can differ between vendors and between delivery and pickup. Coupons and promotions apply only when their conditions are met; see the Promotions & Coupon Terms.

6Availability#

Menu items and grocery products depend on what the vendor has available. If something you ordered is unavailable, the vendor or our support team will contact you or remove it, and you are not charged for items you do not receive.

7Delivery and pickup#

Give a complete, reachable delivery address and any instructions the driver needs. Delivery times are estimates, not guarantees. Pickup orders are collected from the vendor. Delivery problems are covered by the Delivery Policy.

8Food allergies#

Check the allergen and ingredient information the vendor provides and tell the vendor about allergies in your order notes. Vendors prepare food in shared kitchens, so cross-contact can happen. Neither ZUKA nor the vendor guarantees that an item is free of an allergen unless that has been specifically confirmed to you. See the Food Safety & Allergen Policy.

9Payments and refunds#

You authorise us to charge your chosen payment method (card via Stripe, PayPal, or Zuka Credit) for the order total. Refunds are reviewed and issued by ZUKA platform support, not by vendors. See the Payment & Billing Terms and the Refund & Cancellation Policy.

Nothing in these Terms excludes consumer rights that cannot legally be waived.

10Acceptable use#

Do not place fraudulent orders, abuse payments, refunds or coupons, threaten or harass vendors, drivers or staff, impersonate others, or try to access our systems without permission. The Acceptable Use Policy has the details. We may suspend accounts that break these rules.

11Intellectual property#

The ZUKA name, logos, app software, designs and original content belong to Zukaongo or its licensors. We give you a limited, personal, revocable licence to use the apps and website under these Terms. Vendor names, menus and photos belong to the vendors.

12Changes to the service#

We may change, pause or interrupt parts of ZUKA for maintenance, security, safety, operational or legal reasons.

13Liability#

Vendors are responsible for the food and products they sell, including quality, ingredients and allergens. Drivers are responsible for handling the deliveries they accept.

To the extent the law allows, Zukaongo is not liable for indirect or consequential losses or for the acts of vendors and drivers. Nothing in these Terms limits liability that cannot legally be limited, including statutory consumer rights or liability for negligence that causes death or personal injury.

14Governing law#

Services in the Cayman Islands are governed by Cayman Islands law, and the Cayman Islands courts have jurisdiction, subject to any mandatory protections where you live. U.S. activities are governed by the applicable U.S. law.

15Changes to these Terms#

We may update these Terms. Each version shows its effective date, and we tell you about material changes in the app or by email where the law requires. The current version is always at zukaongo.com/legal/terms-of-service.
